Terms & Conditions
These Terms & Conditions apply when you access the Layer By Layer Creations website, purchase products from us, request custom work or otherwise use our website and services.
By placing an order, accepting a quote or using our website, you agree to these Terms & Conditions together with any other policies or terms that apply to the relevant product, service or transaction.
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law. Consumer guarantees apply automatically and cannot be removed by business terms.

You may use our website for lawful personal or business purposes associated with viewing, purchasing or enquiring about our products and services.
You must not use the website:
· for unlawful, fraudulent or abusive purposes
· to interfere with the operation or security of the website
· to submit malicious software or harmful content
· to impersonate another person or misrepresent information
· to attempt unauthorised access to website systems or customer information
· in any other way that may reasonably damage Layer By Layer Creations, our customers or our service providers.
Product information
We aim to provide accurate product descriptions, specifications, dimensions, colours, images and other information.
Because many of our products are manufactured or finished by us, minor variations may occur between individual items.
This may include reasonable variation in:
· colour or material appearance
· texture or finish
· 3D-print layer lines or other characteristics inherent to additive manufacturing
· laser-cut or engraved finishes
· dimensions within normal manufacturing tolerances
· placement or appearance of personalised elements.
Such normal manufacturing characteristics are not necessarily defects.
Where dimensions or suitability are important for a particular use, customers should review the product information carefully and contact us before ordering if clarification is required.
Product images and colours
Product images are intended to represent our products as accurately as practical.
Colours and finishes may appear differently depending on:
· screen settings
· lighting
· photography
· material batches
· manufacturing processes.
Where exact colour matching is important, please contact us before ordering.
Availability and made-to-order products
Many Layer By Layer Creations products are made to order.
An item being available to purchase on the website does not necessarily mean that a finished unit is currently held in stock.
Production timeframes may therefore apply before dispatch. Estimated lead times are provided on relevant product pages or otherwise communicated as part of the order process.
Small quantities of finished stock may occasionally be available, but customers should generally expect the published production timeframe unless advised otherwise.
Prices
Prices displayed on the website are in Australian dollars (AUD) unless stated otherwise.
Layer By Layer Creations is not currently registered for GST, so GST is not currently added to website prices.
Website prices should represent the customer price for the relevant product and selected configuration, excluding any separately calculated shipping or optional extras not yet selected.
We aim to ensure that all prices displayed are clear and accurate, and that any unavoidable charges that can be determined in advance are included or clearly disclosed before the customer completes their purchase.
We may change product prices from time to time. A price change will not ordinarily affect an order that has already been accepted and paid, except where an obvious pricing or system error has occurred and the order has not yet been fulfilled.
Orders
Submitting an order through our website is an offer to purchase the selected products.
An order is not considered fully accepted until:
· the order has been successfully submitted
· required payment has been received or authorised
· we have confirmed that the product or service can reasonably be supplied.
We reserve the right to contact you if there is an issue with:
· product availability
· configuration or personalisation information
· supplied files
· pricing
· shipping
· production feasibility
· other information required to fulfil the order.
Where an order cannot reasonably be fulfilled, we will contact you to discuss the available options.
Payment
Website orders must be paid using the payment methods made available at checkout.
Payment processing may be provided by Shopify or other approved third-party payment providers.
Production will not begin until the required payment has been received, except where another payment arrangement has been specifically agreed.
Product configuration and customer selections
Customers are responsible for reviewing the configuration options they select before placing an order.
This may include:
· product size
· colour
· material
· style
· background
· finish
· personalisation
· engraving
· uploaded artwork
· other product-specific options.
Where a customer selects an incorrect option, this will generally be treated as a change-of-mind issue unless the product supplied differs from the option actually ordered.
Personalisation
Customers are responsible for checking all text, spelling, names, dates, numbers and other personalisation information before submitting an order.
We may adjust reasonable layout features such as text size, spacing, line breaks or placement where required to achieve a suitable production result.
Where a proof is provided for approval, the customer is responsible for reviewing the proof carefully before approving it.
Once a proof has been approved and production has commenced, changes may not be possible.
Customer-supplied artwork and files
Customers may provide artwork, images, logos, 3D models or other files for certain products or custom services.
By supplying content to us, you confirm that:
· you own the relevant content or have appropriate permission to use it
· our use of the content for your order will not knowingly infringe another person's intellectual property or other rights
· the information supplied is accurate and suitable for the requested work.
We may refuse to reproduce material where we reasonably believe that doing so would be unlawful, unsafe or inappropriate.
If supplied files require repair, conversion, modelling, vectorisation or other preparation, additional design/setup charges may apply.
Design and setup charges
Where additional design or file-preparation work is required, applicable design/setup charges will be advised before that work proceeds.
Our current structure is:
Basic design / setup fee - A$37.50
· Covers up to approximately 45 minutes of straightforward design, file preparation or production setup.
Additional design / modelling - A$50 per hour
· Additional work is charged in 15-minute increments at A$12.50 per increment.
Where the required work is unclear, supplied files will be reviewed before the applicable design/setup charge is confirmed.
Additional charges will not be incurred without the customer being advised first.
Custom display cases
Where a customer requests a display case for an item not currently represented in our catalogue, the request will first be assessed to determine whether it can reasonably be developed as a standard catalogue product.
If the requested case can be developed using our standard construction methods and specifications, and the resulting design is suitable for future sale to other customers, a separate design fee will not be charged for the standard case development.
Additional design/setup charges may apply where the customer requests:
· personalised engraving, plaques or other customer-specific details
· bespoke dimensions or construction outside our standard case approach
· one-off modifications that would not form part of the standard catalogue product
· other unique design requirements requiring additional design work.
Any applicable design/setup charges will be confirmed with the customer before work proceeds.
Custom quotes
Custom work is subject to review and quotation before production begins.
Most custom enquiries are expected to receive a quote within approximately 3-5 business days, provided sufficient information has been supplied.
Complex enquiries may require additional assessment.
Quotes should specify the relevant:
· products or services
· scope of work
· pricing
· design/setup costs
· shipping where known
· deposit/payment requirements
· estimated production timeframe
· other material conditions.
Unless otherwise stated, a quote does not require the customer to proceed with the work.
Custom-job deposits and payment
For custom jobs quoted at less than A$100, full payment is required before production begins.
For custom jobs quoted at A$100 or more, a 50% deposit is required before production begins, with the remaining balance payable before dispatch or collection.
Customers may choose to pay the full quoted amount upfront if preferred.
For particularly large, complex or material-intensive projects, a different payment structure may be specified as part of the quote.
Production timeframes
Production and processing times vary by product and service.
General timeframes are described in our Shipping Policy, with more specific made-to-order lead times shown on individual product pages where applicable.
Custom production times will depend on the complexity of the job, quantity, material availability, design approvals and current workload.
Any requested deadline or event date should be communicated before the order is accepted. We will aim to accommodate required dates where practical but cannot guarantee a deadline unless it has been expressly agreed.
Shipping and local pickup
Shipping, dispatch, oversized-product delivery and local-pickup arrangements are governed by our Shipping Policy.
Customers are responsible for providing complete and accurate shipping information.
Local pickup is available for suitable orders by arrangement in Canberra / ACT.
Returns, refunds and cancellations
Returns, refunds, exchanges and order cancellations are governed by our Returns, Refunds & Cancellations Policy.
Layer By Layer Creations does not provide returns or exchanges for change of mind.
Personalised, bespoke and custom products are subject to specific cancellation conditions once production has commenced, as set out in the Returns, Refunds & Cancellations Policy.
Nothing in these terms limits any rights or remedies available under the Australian Consumer Law.
Consumer guarantees
Our products and services come with consumer guarantees that apply automatically under the Australian Consumer Law.
These rights cannot be excluded simply through website terms, returns policies or other business conditions.
Where a product or service fails to meet an applicable consumer guarantee, the remedy will depend on the circumstances and the requirements of the Australian Consumer Law.
Discounts, bundles and promotions
Discounts, bundles or promotional offers may be offered from time to time.
Each promotion may be subject to specific conditions, including:
· eligible products
· minimum spend
· start and end dates
· discount amount or percentage
· exclusions
· whether discounts may be combined.
Unless expressly stated otherwise, promotional discounts should not be assumed to stack with other offers or existing bundle/quantity pricing.
Where a specific promotion has additional terms, those terms will apply together with these Terms & Conditions.
Reviews and customer content
Where website functionality allows customers to submit product reviews or testimonials, submitted content may be displayed publicly.
Customers should not include private contact details or other unnecessary personal information in public review content.
We may moderate reviews where reasonably necessary to remove:
· personal information
· unlawful content
· spam
· abusive content
· content unrelated to the product or customer experience.
We will not knowingly create or publish fabricated customer testimonials or reviews.
Intellectual property
Unless otherwise stated, website content created by or for Layer By Layer Creations, including original:
· text
· graphics
· branding
· photographs
· product designs
· layouts
· illustrations
· website content
is owned by or licensed to Layer By Layer Creations and is protected by applicable intellectual-property laws.
You may not reproduce, distribute, commercially exploit or substantially copy our original content without permission, except where permitted by law.
Third-party trademarks, product names, images or intellectual property remain the property of their respective owners.
LEGO® and other third-party brands
Where we refer to LEGO®, set names, model numbers or other third-party brands, those references are used to identify compatibility or the products/items for which our accessories or display solutions are intended.
Layer By Layer Creations is an independent business and is not affiliated with, endorsed by or sponsored by the LEGO Group or other third-party brand owners unless expressly stated.
LEGO® is a trademark of the LEGO Group.
Safety and intended use
Products should be used only for their intended purpose and in accordance with any product-specific instructions or warnings provided.
Some products may contain small parts, sharp edges, magnets or other components unsuitable for young children.
Customers are responsible for assessing whether a product is appropriate for its intended environment and user.
Product-specific safety information should take precedence where provided.
Custom 3D-printed or fabricated parts
Custom-manufactured parts will be produced based on the information, files and intended use communicated by the customer.
Unless expressly agreed otherwise, our custom manufacturing services are not engineering certification services.
Customers should inform us where a part is intended for a safety-critical, structural, high-temperature, food-contact, medical, electrical or other specialised application so suitability can be assessed before we agree to produce it.
We may decline jobs where the requested use is outside our capabilities or where we are not confident the item can be produced safely or appropriately.
Refusal of service
We reserve the right to decline an order, enquiry or custom job where we reasonably consider that:
· the requested work is unsafe
· the material is unsuitable
· the work may be unlawful
· required intellectual-property permissions appear to be absent
· the job is outside our production capabilities
· the requested timeframe is not feasible
· the customer behaves abusively or fraudulently
· another legitimate business reason prevents us from accepting the work.
Any such discretion should be exercised reasonably and consistently with applicable law. Broad or one-sided contractual powers can raise unfair-contract-term concerns, so this clause should not be treated as an unrestricted right to cancel accepted orders arbitrarily.
Website availability
We aim to keep the website accurate, secure and available but cannot guarantee uninterrupted access at all times.
Temporary interruptions may occur due to maintenance, technical issues, third-party systems or events outside our reasonable control.
Errors and corrections
We may correct typographical errors, inaccurate product information, technical errors or obvious pricing mistakes where identified.
If an error materially affects an order already placed, we will contact the customer to discuss the available options rather than unilaterally substituting a materially different product or price.
Liability
To the extent permitted by law, Layer By Layer Creations is not responsible for losses caused solely by:
· misuse of a product
· use contrary to supplied instructions
· unauthorised modifications
· inaccurate information or files supplied by the customer
· circumstances beyond our reasonable control.
Nothing in this section excludes or limits liability where doing so would be unlawful or would restrict rights under the Australian Consumer Law.
Privacy
Personal information is handled in accordance with our Privacy Policy.
Third-party services and links
Our website may use or link to third-party platforms, payment providers, carriers and other services.
Those services may be subject to their own terms and privacy policies.
Layer By Layer Creations is not responsible for the content or independent practices of third-party websites that we do not control.
Changes to these Terms & Conditions
We may update these Terms & Conditions from time to time to reflect changes to our products, services, website, business practices or applicable requirements.
Changes will apply from the date the updated terms are published and will not ordinarily alter rights or obligations that have already arisen under an accepted order.
Governing law
These Terms & Conditions are governed by the laws applicable in the Australian Capital Territory and Australia.
Nothing in this clause limits any rights a customer may have under applicable Australian consumer protection laws.
